Welcome to Fine Coffee Store (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of the website at finecoffeestore.com (the “Site”) and any purchase made through it. By browsing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your province or territory of residence, and have the legal capacity to enter into a binding contract to place an order on the Site. You agree to provide accurate, current, and complete information when ordering.

3. Products and Descriptions

We make reasonable efforts to ensure product descriptions, images, weights, and prices are accurate. Minor variations between product images and the item delivered (e.g., packaging updates by a roaster or supplier) do not constitute a defect. We reserve the right to limit quantities and to discontinue any product at any time.

4. Prices and Taxes

All prices on the Site are listed in Canadian dollars (CAD) and exclude applicable taxes unless otherwise stated. Harmonized Sales Tax (HST), Goods and Services Tax (GST), and/or Provincial Sales Tax (PST) are calculated at checkout based on the delivery address of your order, in accordance with Canadian federal and provincial tax laws. We reserve the right to correct pricing errors at any time before an order is confirmed, and to cancel any order affected by such an error with a full refund.

5. Order Acceptance

Placing an order is an offer to purchase; our order confirmation email acknowledges receipt of that offer but does not by itself constitute acceptance. We may refuse or cancel an order — including for pricing errors, suspected fraud, or unavailable stock — in which case any payment made will be refunded in full. Before you complete your purchase, we provide a clear, itemized breakdown of the goods, their price, all mandatory charges, taxes, and shipping terms.

6. Payment Methods and Billing

We accept payments in Canadian Dollars (CAD) via PayPal and major credit/debit cards processed through PayPal Checkout (including Visa, Mastercard, and American Express).

By submitting an order, you authorize us (via our third-party payment processor, PayPal) to charge the designated payment method for the total amount of your order, including applicable taxes. All transactions are securely encrypted using Secure Sockets Layer (SSL) technology. We do not store or have access to your full credit card or PayPal account credentials on our servers.

Your account will be billed immediately upon order submission. If payment is declined or cannot be processed, your order will be automatically cancelled.

7. Shipping

We currently ship exclusively within Canada, with the exception of the Province of Quebec. Due to language and regulatory requirements, we do not ship, and cannot accept orders for delivery, to addresses within Quebec or outside of Canada. Shipping is free on every order to all eligible Canadian provinces and territories, with no minimum purchase required. 8. Cancellations and Returns

Orders may be cancelled or returned in accordance with our Return and Refund Policy. This voluntary policy is in addition to, and does not limit, any statutory rights or remedies available to you under applicable provincial consumer protection legislation, including the Consumer Protection Act (Ontario).

9. Intellectual Property

All content on the Site — text, graphics, logos, product photography, and the “Fine Coffee Store” name and branding — is owned by or licensed to us and protected under Canadian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Fine Coffee Store is not liable for indirect, incidental, or consequential damages arising from your use of the Site or products purchased through it. Nothing in these Terms limits any right or remedy that cannot be excluded under the Consumer Protection Act (Ontario) or other applicable Canadian consumer protection legislation.

11. Marketing Communications

We will only send marketing emails or texts where you have given express or implied consent, in accordance with Canada’s Anti-Spam Legislation (CASL). Every marketing message will identify us and include a working unsubscribe mechanism. You can withdraw consent at any time.

12. Privacy

Our collection, use, and disclosure of your personal information is described in our Privacy Policy, which forms part of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Subject to any right you may have to bring proceedings before the court of your own place of residence under applicable consumer protection law, any disputes arising under these Terms will be submitted to the competent courts of the judicial district of Toronto, Ontario.

14. Changes to These Terms

We may update these Terms from time to time. The version published on the Site at the time of your order governs that order. Continued use of the Site after an update constitutes acceptance of the revised Terms.

15. Language / Langue

This website, its content, and all terms, policies, and transactions are provided exclusively in English. We do not provide services or fulfill orders in the Province of Quebec.
